The agreement governing your use of besta.ai Last updated: November 1, 2025 Please read these Terms carefully—they outline your responsibilities, our commitments, and how we work together to deliver reliable AI automations. 1. Overview These Terms of Service govern your access to and use of besta.ai (“we”, “us”, or “our”) and the automation tools we provide for real estate professionals. By creating an account, accessing the dashboard, or using any accompanying services or hardware, you agree to be bound by these Terms. If you are accepting these Terms on behalf of a business or organization, you confirm that you have authority to bind that entity. If you do not agree with these Terms, you must not access or use the services. 2. Accounts & Eligibility To use besta.ai you must register an account and provide accurate, current, and complete information. Accounts are intended for professional use by real estate agents, teams, and brokerages. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately if you become aware of any unauthorized access. You represent that you are legally able to enter into a binding agreement. You agree to keep your contact and billing information up to date. You must not share login credentials outside of your organization unless expressly permitted. 3. Platform Services besta.ai provides workflow automation, lead management, content generation, and analytics tools tailored to the real estate industry. The platform may integrate with third-party services that you choose to connect. You are responsible for the accuracy of the data you upload, the automations you configure, and the communications you send using our tools. You must only process personal data that you have a lawful basis to use. 4. Subscriptions & Payments Access to certain features of besta.ai requires a paid subscription. Pricing, billing frequency, and plan features are described at the point of purchase or in your order form. Fees are non-refundable except where required by law or explicitly stated otherwise. You authorize us and our payment processors to charge all applicable fees using the payment method on file. We may modify pricing or plans with prior notice. Changes will apply from the start of your next billing cycle. If a payment cannot be collected, we may suspend or downgrade your account until the balance is settled. Taxes, duties, or levies imposed by authorities are your responsibility unless otherwise stated. 5. Hardware & Integrations Certain plans may include NFC cards or other physical materials designed to simplify customer engagement. You are responsible for using hardware in accordance with applicable laws and platform guidelines. We may provide integrations with external systems (such as CRMs or marketing tools). Integrations are offered on an “as available” basis and may be subject to the separate terms of those providers. You authorize us to exchange data with third-party platforms that you connect to your account. 6. AI-Generated Content Our services may generate automated suggestions, messages, or creative content using artificial intelligence. AI outputs are provided to assist your team, but you remain responsible for reviewing all generated content before sharing it with prospects or clients. We do not guarantee that AI-generated content will be accurate, lawful, or suitable for every use case. You must ensure compliance with applicable advertising, fair housing, and privacy regulations when using AI outputs. 7. Intellectual Property besta.ai, including its software, design, logos, and documentation, is owned by Nuvem Catita Unipessoal Lda or its licensors. Using the services does not grant you ownership rights to our intellectual property. You grant us a limited license to use the data and content you upload for the purpose of providing and improving the services, and to comply with legal obligations. You represent that you have the necessary rights to grant this license. 8. Suspension & Termination You may cancel your subscription or close your account at any time through the dashboard or by contacting support. Cancellation will take effect at the end of your current billing cycle, unless otherwise agreed. We reserve the right to suspend or terminate access if: You breach these Terms or any applicable policies. Your account is used for unlawful, fraudulent, or abusive activities. Required fees remain unpaid after reasonable notice. 9. Limitation of Liability To the maximum extent permitted by law, besta.ai is provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Our aggregate liability arising out of or relating to the services will not exceed the fees you paid to us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages. 10. Governing Law These Terms are governed by the laws of Portugal. Any disputes arising from or relating to these Terms or the services will be submitted to the exclusive jurisdiction of the courts of Cascais, Portugal, unless another jurisdiction is required by mandatory law. 11.
